Terms and Conditions
These terms and conditions are entered by and between Leo’s Fitness Lab, LLC (hereinafter: “Leo’s Fitness Lab”) and You (hereinafter: “the Member”).
Services: The membership entitles the usage of Leo’s Fitness Lab’s services. Free trials are reserved for San Diego residents. (Proof of residency will be required)
Membership: The membership is personal and cannot be shared.
Age Limit: The Member confirms that he/she is 18 years old or older. For minors, exceptions are granted based on written parental consent.
Use of the Facilities: The facility shall be used for training purposes only. No other activity will be allowed, and violations will be sanctioned. For example, sleeping and lingering are not allowed. Consumption of alcohol, tobacco or illegal substances is not allowed. Working out under the influence is not allowed. Conducting business or paid services is not allowed.
Code of Conduct: The Member shall respect the behavioral and operating principles and follow them on all occasions. This includes but is not limited to: • Wearing appropriate and clean clothes and shoes. • Using a towel at every workout and leaving machines and surfaces clean after usage. • Behaving in a friendly and respectful manner towards the other members in the workout facility as well as the staff.
Lockers for Personal Belongings: Lockers are available for Members while working out in the facility. Each Member needs to empty the locker and remove the padlock when leaving the facility. Leo’s Fitness Lab will open and empty lockers if the Member is not in the facility.
Lost Property or Theft: Leo’s Fitness Lab does not take responsibility for loss or theft of any personal belongings, even if locked in a locker.
Access & Security: Leo’s Fitness Lab is open from 7am to 5pm unless designated otherwise. The Member guarantees to never let in any other member, nor another person into the Leo’s Fitness Lab premises.
Suspension/Termination of Membership: If the Member behaves in a way that breaches the code of conduct, interferes or disturbs other members or staff, or that the management considers inappropriate, the membership can be suspended or terminated at management’s sole discretion. If the Member does not pay the membership fees, the membership can be suspended or terminated at management’s sole discretion.
Payment: The Member commits to paying the membership according to the conditions in the contract. The Member is responsible for all payments, also in the case of automatic debits by Leo’s Fitness Lab. Leo’s Fitness Lab will send reminders by email. In the case that the email reminders are not received, it does not remove the responsibility from the Member to pay in time. If card on file declines at any time, you will receive an email from Leo’s Fitness Lab to update to an active form of payment.
Renewal & Cancellation: All session fees are paid in full before scheduling any Leo’s Fitness Lab services. Unused sessions may be refunded at the discretion of Leo’s Fitness Lab management and may take up to 30 days to process after all paperwork has been submitted.
Price Changes: All prices are fixed for any previously purchased sessions. A price change can be implemented at any time by Leo’s Fitness Lab management.
No Show: Leo’s Fitness Lab does not offer a refund or credit for booked sessions that a member fails to attend.
Communication: Leo’s Fitness Lab communicates via email. Leo’s Fitness Lab declines all responsibility if the email address doesn’t exist, is wrong or for whatever reason emails do not arrive to the Member.
Health: The Member confirms that he/she does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Member’s health, safety or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise. Leo’s Fitness Lab shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done at Leo’s Fitness Lab, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a program and not for diagnostic purposes.
Insurance: The Member confirms that he/she holds the necessary insurances to cover any accident or training incident. Leo’s Fitness Lab shall not be subject to any claim, demand, or injury whatsoever with regard to the assessment of the Member’s health condition or for any injury arising out of the Member’s disability, impairment or ailment.
Liability: Each member of Leo’s Fitness Lab shall be liable for any property damage and/or personal injury caused by the Member at the Leo’s Fitness Lab premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof. Under no circumstances, including negligence, shall Leo’s Fitness Lab and Leo’s Fitness Lab Employees be liable for any direct, indirect, incidental, exemplary, economic, punitive, lost profit, special or consequential damages or for any damages that result from or are related to the use of or inability to use the services or any failure of performance. These Terms and Conditions may only be altered by a prior written mutual agreement between Leo’s Fitness Lab and Member.
Waiver of Liability: I hereby acknowledge that use of the workout facilities and equipment, participation in the classes, and in the training provided at Leo’s Fitness Lab by Leo’s Fitness Lab exposes me to inherent risks which can include accidents, falls, illness, injury or even death.
I confirm that I know of no medical, physical or mental reasons why I would not be capable of performing the physical activity in which I choose to participate at Leo’s Fitness Lab. I acknowledge my responsibility in communicating to a staff member prior to commencing activity, any physical and/or mental concerns affecting me which could conflict with participation in my chosen activities.
I assume all risks of injuries associated with use of Leo’s Fitness Lab and its facilities including, but not limited to falls, contact with other participants, exercises and techniques taught to me by trainers employed by or providing services for Leo’s Fitness Lab and all other risks being known and appreciated by me.
Having read this waiver and knowing these facts, in consideration of accepting my use of the facilities and of services provided to me at Leo’s Fitness Lab by Leo’s Fitness Lab, I agree to Hold Harmless, Waive and Release Leo’s Fitness Lab, its directors, employees, representatives, anyone else providing a service at Leo’s Fitness Lab and successors from any responsibility, liabilities, demands or claims of any kind arising out of my use of facilities at Leo’s Fitness Lab or out of my participation in training, classes or anything else organized by or on behalf of Leo’s Fitness Lab.
I confirm that I have read and understand this Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.
This Applies to Apps, and Leo’s Fitness Lab Website: All these Terms and Conditions apply to our apps, and the leofitlabs.com website too. Use of our apps, and website is also at your own risk. They are provided as a service to our members and guests without charge, and we disclaim any and all responsibility for them. We do not screen our users, so please use good judgment and common sense in deciding whom to meet or trust with your personal information. We do not provide contact details to other members through any of our apps and instead route all messages through us. You can also report threats, abuse or any other inappropriate conduct by contacting Leo’s Fitness Lab management at Email Address,getfit@leofitlabs.com.
Court of Jurisdiction: These Terms and Conditions of Use shall be governed by, construed and enforced in accordance with the laws of the State of California and the federal laws of the United States of America. Users agree to submit to the personal and exclusive jurisdiction of the state or federal courts located within the State of California for any disputes arising from or related to the Services or these Terms and Conditions of Use. These Terms and Conditions may be altered by action of Leo’s Fitness Lab management in which case all members will be notified by email. Failure by Leo’s Fitness Lab to object to a member’s behavior, conduct or action does not constitute a consent, ratification or waiver of objection.
